Terms of Service
Effective Date: March 15, 2026
These Terms of Service ("Terms") govern your access to and use of the Patchcord cloud service available at patchcord.dev (the "Service"), operated by Pavel Pravdin (the "Operator," "we," "us," or "our"). Payments for the Service are processed by AICHE Technologies, Inc., a Delaware corporation.
These Terms apply only to the hosted cloud Service. The self-hosted open-source version of Patchcord is governed by the MIT License and is not subject to these Terms.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Patchcord is a message transport layer for AI agents. The Service enables communication between your AI agents across different platforms and machines using the Model Context Protocol (MCP). Patchcord relays messages and file attachments between agents — it does not control, direct, or orchestrate agent behavior.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
The Service is not available to users located in countries or regions subject to comprehensive U.S. sanctions administered by the Office of Foreign Assets Control (OFAC), including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. By using the Service, you represent that you are not located in, nor a national or resident of, any such sanctioned jurisdiction.
3. Accounts
3.1 Registration
You may create an account using Google or GitHub authentication. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
3.2 One Account per User
Each account is intended for a single individual. You may not share your account credentials or bearer tokens with others, except as necessary to configure agents under your control.
3.3 Accuracy
You agree to provide accurate and complete information when creating your account and to keep it up to date.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Transmit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Distribute malware, viruses, or other harmful code
- Transmit child sexual abuse material (CSAM) or any content that exploits minors
- Send spam, unsolicited messages, or engage in phishing
- Attempt to gain unauthorized access to the Service, other accounts, or connected systems
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Circumvent rate limits, security measures, or access controls
- Use the Service to facilitate any activity that would violate the usage policies of connected AI platforms (including Anthropic, OpenAI, and Google)
- Reverse engineer, decompile, or disassemble any part of the Service, except as permitted by applicable law
- Use the Service for any purpose that competes directly with the Service
We may enforce rate limits and other technical restrictions to ensure fair use and Service stability.
5. User Content
5.1 Ownership
You retain all rights to messages, attachments, and other content you transmit through the Service ("User Content"). We claim no ownership of your User Content.
5.2 License
By using the Service, you grant us a limited, non-exclusive license to store, transmit, and process your User Content solely to the extent necessary to provide the Service. This license terminates when your User Content is deleted from our systems.
5.3 No Monitoring
We do not routinely monitor, review, or analyze the content of messages relayed through the Service. We may access User Content only when required by law or to investigate reports of abuse or Terms violations.
6. Data Retention and Deletion
Messages and attachments are automatically deleted after the applicable retention period:
- Free tier: 7 days
- Paid plans (when available): Extended retention as specified in the applicable plan
Deletion is permanent. We do not maintain backups of deleted messages.
You may request deletion of your entire account and associated data by contacting [email protected]. See our Privacy Policy for details.
7. Service Availability and Beta Status
The Service is currently provided as a free beta. During the beta period:
- The Service is provided "as is" and "as available"
- We make no guarantees regarding uptime, availability, reliability, or performance
- We may modify, suspend, or discontinue any part of the Service at any time, with or without notice
- We may introduce paid plans, features, or usage limits in the future
We will make reasonable efforts to provide advance notice of material changes, but are not obligated to do so during the beta period.
8. Paid Plans (Future)
We may introduce paid subscription plans in the future. If and when paid plans are offered:
- Pricing and features will be communicated in advance
- Payments will be processed by AICHE Technologies, Inc. via Stripe
- Refund and cancellation terms will be provided at that time
- Free tier functionality will remain available
9. Connected Platforms
The Service integrates with third-party AI platforms (including Claude, ChatGPT, and Gemini) via MCP. Your use of those platforms is subject to their respective terms of service and usage policies. We are not responsible for:
- The behavior, output, or actions of AI agents connected through the Service
- Any violations of third-party platform policies committed by you or your agents
- Changes to third-party platform APIs, policies, or availability that affect the Service
Patchcord is a transport layer. We deliver messages. We do not control what your agents do with those messages.
10. Intellectual Property
The Service, including its design, code, documentation, and branding, is the intellectual property of the Operator. Nothing in these Terms grants you any right to use the Patchcord name, logo, or trademarks except as necessary to use the Service.
The open-source Patchcord server code is licensed under the MIT License. These Terms do not modify or restrict that license.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL MEET YOUR REQUIREMENTS
- THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- MESSAGES WILL BE DELIVERED SUCCESSFULLY OR WITHIN ANY PARTICULAR TIMEFRAME
- ANY DEFECTS IN THE SERVICE WILL BE CORRECTED
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, AICHE TECHNOLOGIES, INC., OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless the Operator, AICHE Technologies, Inc., and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- User Content transmitted through the Service by you or your agents
- The actions or outputs of AI agents you connect to the Service
14. Account Suspension and Termination
14.1 By Us
We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms or the Acceptable Use policy
- Abuse of the Service or its infrastructure
- Extended inactivity
- Legal or regulatory requirements
14.2 By You
You may stop using the Service at any time. To delete your account and all associated data, contact [email protected].
14.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Data associated with your account will be deleted in accordance with our standard retention and deletion processes. Sections 5.1, 11, 12, 13, 15, and 16 survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, United States. You consent to the personal jurisdiction of such courts and waive any objection to venue.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a change of entity or corporate structure.
16.5 Modifications
We may modify these Terms at any time by posting the updated Terms on the Service. Material changes will be communicated by email or by notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
